4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

We may use cookies and similar tracking technologies (like web beacons, pixels, and browser local storage) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services, keep you signed in to the App, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We also permit third parties and service providers to use online tracking technologies on our website for analytics and advertising, including to help manage and display advertisements, to tailor advertisements to your interests, or to send abandoned shopping cart reminders (depending on your communication preferences). The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear either on our Services or on other websites. We do not place advertising trackers inside the App.

To the extent these online tracking technologies are deemed to be a "sale"/"sharing" (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by submitting a request as described below under section "DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?"

You can also set your browser to refuse or delete cookies. If you block cookies needed to keep you signed in, parts of the App may not work.

Google Analytics

We may share your information with Google Analytics to track and analyze the use of our website. To opt out of being tracked by Google Analytics across the Services, visit https://tools.google.com/dlpage/gaoptout. For more information on the privacy practices of Google, please visit the Google Privacy & Terms page.

Mixpanel

We use Mixpanel for analytics inside the App, as described in Section 1.

5. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

For the App, we keep your account information, content, and Client Data for as long as your account is active. When you delete your account, we delete or anonymize this information within 30 days, except where we must keep certain records (such as billing records) for legal, tax, or accounting reasons, and except for copies in routine backups, which are overwritten on their normal schedule.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

6. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. For the App, these include encrypting data in transit (HTTPS), restricting access to account data to the account holder and to us as needed to operate and support the App, and requiring authentication to access accounts.

However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment, and App users should keep their password confidential and sign out on shared devices.

If we learn of a security incident affecting your personal information, we will notify you and any authorities as required by applicable law.

7. DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. App accounts are available only to individuals 18 and older. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at becca@alignpilatesmovement.com.

Instructors who teach minors and choose to record information about them in the App are responsible for obtaining any required permission from a parent or guardian (see Section 13).

8. WHAT ARE YOUR PRIVACY RIGHTS?

You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

Withdrawing your consent

If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications

You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying "STOP" or "UNSUBSCRIBE" to the SMS messages that we send, or by contacting us using the details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account or subscription, to respond to service requests, or for other non-marketing purposes.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.

If you have questions or comments about your privacy rights, you may email us at becca@alignpilatesmovement.com.

9. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

10. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law.

11. ALIGN FLOW APP

Align Flow is a web-based application for Pilates instructors, owned and operated by Align Pilates & Movement LLC. It can be used in a web browser or installed on your device directly from our website, www.alignflow.app. It is not distributed through the Apple App Store or Google Play.

When you use the App, we process:

  • Your account information (name, email address, sign-in credentials, and profile details)
  • Your professional information (such as studio or business name, certifications, and teaching preferences)
  • Content you create or save (such as class plans, sequences, cues, and notes)
  • Client Data you choose to enter about your own clients (see Section 13)
  • Prompts you submit to AI features and the responses generated (see Section 12)
  • Subscription and billing records (payments are processed by Stripe)
  • Usage and device information, including analytics collected through Mixpanel

Content you create in the App belongs to you. We access it only as needed to operate, secure, support, and improve the App, to respond to your requests, or as required by law. We do not use your content or Client Data for advertising, and we do not sell it.

If the App offers early access, free trials, or feedback programs, we may contact participants to ask about their experience. Participation is voluntary.

12. ARTIFICIAL INTELLIGENCE FEATURES

The App includes features powered by artificial intelligence provided by Anthropic, PBC ("Anthropic") through its Claude models. When you use an AI feature, the information you submit — such as your request, relevant class content, and any client details you include — is sent to Anthropic to generate a response, which is returned to you in the App.

  • Anthropic processes this information as our service provider. Under Anthropic's commercial terms, it does not use content submitted through its API to train its models by default. Anthropic's privacy information is available at https://www.anthropic.com/legal/privacy
  • We do not use your prompts, content, or Client Data to train AI models.
  • Only include the information needed for your request. Where possible, avoid entering full names or other details that identify a client in AI prompts.
  • AI-generated content can be inaccurate or incomplete. It is a tool to support your professional judgment, not a substitute for it, and it is not medical advice. You are responsible for reviewing AI output and deciding whether it is safe and appropriate for any client.

13. CLIENT DATA ENTERED BY INSTRUCTORS IN ALIGN FLOW

Instructors may choose to store information about their own clients in the App, such as names, contact details, session notes, and health, injury, or fitness information ("Client Data"). Whether and how much Client Data to enter is up to each instructor.

Who is responsible

For Client Data, the instructor decides what to collect and how to use it, and is responsible for it. Align Pilates & Movement stores and processes Client Data on the instructor's behalf, only to provide the App to that instructor, and not for our own marketing or any other purpose.

Instructor responsibilities

By entering Client Data into the App, you confirm that:

  • You have the right to collect and store the information, and have given your clients any notice and obtained any consent required by law (including any required parent or guardian consent for minors)
  • You will collect only the information you need to teach safely and effectively
  • You will keep your account credentials secure and remove Client Data you no longer need
  • You will respond to your clients' requests to access, correct, or delete their information

How we protect Client Data

Client Data is accessible only through the instructor's account, and by us only as needed to operate, secure, and support the App or as required by law. We do not sell Client Data or use it for advertising. Client Data is shared only with the service providers needed to run the App (such as hosting providers, and Anthropic when an instructor includes it in an AI request).

The App is a teaching tool and is not intended to be used as a medical record system. Align Pilates & Movement is not a healthcare provider, and Client Data stored in the App is not protected health information under HIPAA.

If you are a client

If your instructor uses Align Flow and you have questions about information they recorded about you, or want it accessed, corrected, or deleted, please contact your instructor. You may also contact us at becca@alignflow.app, and we will work with your instructor to respond.

14. ALIGN FLOW ACCOUNTS, SUBSCRIPTIONS & ACCOUNT DELETION

Accounts

You must be at least 18 to create an App account. You are responsible for the accuracy of your account information and for activity under your account.

Subscriptions and payments

Paid App subscriptions are billed through Stripe. We do not store your full card number. You can cancel your subscription at any time; cancellation stops future renewals but does not delete your account or data.

Deleting your account

You can delete your App account by emailing becca@alignflow.app from the email address on your account, or through account settings in the App if that option is available. Deleting your account deletes your content and Client Data as described in Section 5. If you want a copy of your content before deletion, ask us and we will provide it in a commonly used format where reasonably possible.

15. HEALTH & FITNESS DISCLAIMER

Services provided by Align Pilates & Movement, including the App and any AI-generated content, are for fitness and educational purposes only and are not intended to diagnose, treat, cure, or prevent any medical condition. Clients should consult with a physician or qualified healthcare provider before beginning any exercise program. Participation in sessions is voluntary and undertaken at the client's own risk. Instructors using the App remain responsible for the instruction they provide to their own clients.

16. CLIENT HEALTH & INTAKE INFORMATION (TRAINING SERVICES)

This section applies to clients of Align Pilates & Movement's own training sessions.

Clients may be asked to provide health, injury, or fitness-related information through intake forms or verbal communication. This information is collected solely to help provide safe, appropriate, and effective instruction. All client-provided information is kept confidential. It is not shared with third parties except service providers that store or process it on our behalf under confidentiality obligations, or as required by law. It is not used for marketing or advertising.

17. SCHEDULING, CANCELLATIONS & NO-SHOWS

Appointments must be canceled or rescheduled at least 24 hours in advance. Sessions canceled within 24 hours of the scheduled start time, late cancellations, or no-shows may be charged in full. Late arrivals may result in shortened sessions without a refund to avoid impacting other scheduled clients.

18. IN-HOME & VIRTUAL SESSIONS

For in-home and virtual sessions, clients are responsible for providing a safe, clear, and appropriate space for movement. Align Pilates & Movement is not responsible for injuries resulting from unsafe conditions, inadequate space, or technical limitations during virtual sessions.

19. MEDIA, PHOTOS & TESTIMONIALS

With client consent, photographs, videos, or testimonials may be used for marketing, promotional, or educational purposes. This includes testimonials from App users. Clients and users may opt out of media use at any time by submitting a written request. No identifying information will be shared without explicit consent.

20. INDEPENDENT CONTRACTOR STATUS

Align Pilates & Movement operates as an independent business entity. Instructors are independent contractors and not employees of any affiliated studios, landlords, or third-party platforms unless otherwise stated in writing. Instructors who use the App are independent users of the App and are not employees, agents, or contractors of Align Pilates & Movement by virtue of that use.
